The federal excise tax on a premium cigar is 52.75% of the manufacturer’s price, capped at $0.4026 the structure set by the 2009 SCHIP law. On top of that, every state adds its own tax, from $0 in Pennsylvania to 95% of wholesale in Minnesota.

The federal cigar tax

Cigars are taxed differently from cigarettes at the federal level. A large premium cigar pays 52.75% of the manufacturer’s or importer’s price, but the tax is capped at $0.4026 per cigar — a ceiling set by the 2009 Children’s Health Insurance Program Reauthorization Act (SCHIP). Before SCHIP the rate was 40.08% with a $0.2013 cap. The cap is the reason a $30 Opus X pays the same federal tax as a $4 Factory Smokes: both hit the ceiling. Compare that with cigarettes, which carry a flat federal tax of $1.01 per pack of 20 — about $0.05 per cigarette — and you see why a premium cigar habit is taxed so lightly relative to its price.

The rules distinguish "large cigars" from "small cigars." Small cigars — those weighing three pounds or less per thousand, effectively cigarillos — are taxed per thousand like cigarettes, at the current rate of $50.33 per thousand (about $0.05 per cigar). How tax shows up in retail price

Take a cigar with a manufacturer’s price of $5. The federal cap adds a flat $0.40 wherever you buy it. Then the state tax kicks in — and this is where prices diverge. In a no-tax state the same cigar retails for about $7.50; in New York, 75% of $5 adds $3.75, pushing the retail price past $11. The table below shows the state portion on that $5-wholesale cigar:

Why the same cigar costs different amounts by state

Because most state cigar taxes are a percentage of wholesale price with a per-cigar cap, the tax bill on a premium stick is usually a few dollars or less — unlike cigarettes, where per-stick state taxes of $2–$4 dominate the price. That is why a premium cigar can cost $2–$4 more in New York or Minnesota than in Pennsylvania or Texas, while a $10 cigar still stays near $10–$12 almost everywhere. Finding and calculating your own state's cigar tax

Every state tax agency publishes its tobacco rate; the fastest route is a search for "[your state] cigar tax rate" or the Tax Foundation's annual tobacco-tax tables. When you read the number, note the basis — most states tax a percentage of wholesale price, a few tax per cigar, and the caps vary by state. A 50% "of wholesale" rate is not the same as 50% of the retail price you pay, which is why a low-wholesale-value premium cigar often carries surprisingly little tax even in a high-rate state.

When caps make the sticker rate misleading

Caps flip the tax math on premium cigars. California's 59.17% rate sounds punitive, but its $0.30-per-cigar cap means an $8 stick pays the same tax as a $5 stick — about 4% of the retail price. Connecticut's 50% rate with a $1.00 cap lands near 12% on a $10 cigar. New York and Minnesota, with no caps, are the rare states where the percentage is close to what the sticker suggests. Before using taxes to justify an out-of-state trip or a bulk online order, remember: interstate purchases for resale are illegal, and many retailers will not ship premium cigars into high-tax or restricted states at all.
